THE DIFFUSE AND CONCRETE CONTROL OF DE CONSTITUTIONALITY IN THE CURRENT BRAZILIAN LAW: A CRITICAL VIEW

Abstract

Nowadays, the democratic rule of law is founded on the constitution, whose guarantee of its compliance is the responsability of the constitutional jurisdiction, and its most relevant portion is the control of constitutionality. This article deals with the constitutionality control in the Brazilian legal system, especially a view on the diffuse model, from the binding precedent and general repercussion, institutes that have contributed to a concentration of jurisdiction within the Supreme Court, significantly reducing the importance of the contribution of ordinary judges and courts. As a criticism, questions are raised as to the speed of the of the judgment of constitutional issues, legal certainty and a possible immutability of the constitution’s interpretation.

Desembargador Federal do Tribunal Regional Federal da 5ª Região, Professor Associado da Faculdade de Direito do Recife - Universidade Federal de Pernambuco, instituição na qual concluiu os cursos de Mestrado e Doutorado em Direito Publicou livros, capítulos de livros e vários artigos jurídicos, além de integrar conselhos editoriais de vários periódicos e revistas jurídicas. Já exerceu, dentre outros, os cargos de Juiz de Direito, Juiz Federal e Procurador da República. Sendo, ainda, o segundo ocupante da Cadeira Dezesseis da Academia de Letras Jurídicas do Rio Grande do Norte.
