OS IMPASSES DA ALTERIDADE E AS EXIGÊNCIAS DA JUSTIÇA: DRUCILLA CORNELL E A SUA FILOSOFIA DO LIMITE

Este artigo se propõe a examinar de que maneira a filosofia do limite de Drucilla Cornell pode contribuir para uma teoria crítica do direito com pretensões emancipatórias. Para tanto, adota como fio condutor a maneira como a autora pensa a relação entre o ético e o jurídico, com especial atenção para o lugar das práticas interpretativas nessa teorização. Duas são as perguntas que esta pesquisa pretende responder: de que maneira as práticas jurídicas interpretativas podem ser reconsideradas à luz das exigências da justiça e das demandas dos grupos minoritários? De que forma o engajamento com o ético e com a alteridade pode contribuir para uma reconsideração do sentido da crítica emancipatória no horizonte de uma teoria do direito? A pesquisa se propõe a responder essas indagações por meio de uma leitura abrangente dos trabalhos de Cornell, com maior ênfase em The Philosophy of The Limit, assim como de autores que foram determinantes para essa abordagem, como Jacques Derrida, ou interlocutores frequentes, como Michel Rosenfeld.Referências
